When you buy any of the properties included in our portfolio, you can be absolutely sure that all its documentation and its legal, administrative and town planning situation are in perfect order. You can be sure of this because we have been doing the same job for more than 40 years without a single failure. Furthermore, our services are fully guaranteed by a professional liability insurance policy arranged with the insurer Hiscox Europe Underwriting Ltd (duly authorized and regulated by the Financial Conduct Authority in UK) with a compensation limit of 1.500.000/3.000.000 € for claim/loss.
What if you buy the house directly from the owner or through other real estate agent?
If you decide to buy a house directly from its owner or through another real estate agent who is not an expert in conveyancing or who does not provide a copy of the professional liability insurance policy he should have to guarantee the quality of his services, by taking out our very special Green Stamp Service you still can have the same guarantee as if you had bought a property included in our portfolio. It is a very economical and quality service that can save you a lot of time, many surprises and headaches and thousands of euros.
Our Green Stamp Service is the best you’ll find anywhere because for only 375 € + VAT we will explain you what questions you should ask and what documents you would require from the property owner or his broker to make sure that you are making a good and safe purchase, without hidden costs and avoiding future legal problems with the municipality, with supply companies or with your neighbours.
Review in depth of all the property documentation
Next, our in-house real estate lawyers will review in depth all the documentation provided by the owner, his agent or his lawyer to guarantee not only that the house you want to buy is correctly registered in the Land Registry in the name of the seller but also that it has no mortgages, liens or other types of charges.
Our in-house lawyers will also review a series of other important details to take into account when buying a house, such as, for example, whether the construction of the house or its refurbishment works were carried out with the proper municipal licence; whether or not the urban situation of the house has been regularised, whether its details coincide with those of the Cadastre; whether the house has a valid certificate of occupancy or second occupancy, whether the current owner has paid the Property Tax (IBI), the rubbish collection fees or the water and electricity supply bills and other details necessary to guarantee a safe purchase without unpleasant surprises.
Lawyers recommended by owners of estate agents
Some sellers or their agents will recommend a lawyer and try to persuade you to hire their services, sometimes even free of charge or offering to pay the recommended lawyer’s fees themselves. It would be a big mistake for you to hire the lawyer recommended by the homeowner or his estate agent. There are several obvious reasons why you should reject such a recommendation and use our Green Stamp Service instead.
Firstly, the lawyer recommended to you by the homeowner or his agent will probably not have 40 years of accumulated experience specialising in real estate. Secondly and more importantly, you will run the risk that the recommended lawyer will defend the owner’s or agent’s interests rather than yours. And finally, the fees of a good independent real estate and conveyancing lawyer –normally 1% or 1.5% of the price of the property– would be much higher than the fixed price of our Green Stamp Service, which will be only €375 regardless of the price of the house you want to buy.
When buying a property in Spain, before signing a purchase or deposit contract or giving any money to the owner or his agent as reservation, down-payment or otherwise, you are strongly advised to hire a local and independent lawyer specialised in real estate who can assist you throughout the purchase process or alternatively contract our Green Stamp Service. This last option will be much less expensive but it will also ensure that your money and your rights are fully protected.
